Terms of Service

These Terms of Service ("Terms") govern your access to and use of proqassessment.com and the ProQ™ Progressive Intelligence Assessment (collectively, the "Service"), provided by ProQ Systems ("ProQ," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

Eligibility

You must be at least 16 years old and able to enter into a binding contract to use the Service.

Accounts

You are responsible for the accuracy of the information you provide and for safeguarding your account credentials. Notify us promptly of any unauthorized use.

The Assessment

ProQ™ is a self-reported assessment of progressive intelligence. Your results are generated from your own responses and are intended for personal insight, professional development, and discussion. They are not a clinical, psychological, medical, hiring, or fitness-for-duty determination, and should not be used as the sole basis for any high-stakes decision about you or anyone else.

Acceptable Use

• Do not attempt to reverse-engineer, scrape, or copy assessment items or scoring logic.
• Do not misrepresent your identity or take the assessment on behalf of someone else without consent.
• Do not use the Service to violate any law or infringe the rights of others.
• Do not interfere with the Service, its security, or other users.

Intellectual Property

The ProQ™ name, the assessment, scoring framework, content, and all related materials are owned by ProQ Systems and protected by intellectual-property laws. You retain ownership of the responses you submit; by submitting them you grant us a license to process them in order to operate the Service and to produce de-identified aggregate research.

Fees

The current edition of the assessment is provided as described on the site. We may introduce paid features in the future and will disclose pricing before you are charged.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that results will meet any particular outcome.

Limitation of Liability

To the maximum extent permitted by law, ProQ Systems and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim and (b) USD $100.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

Governing Law

These Terms are governed by the laws of the jurisdiction in which ProQ Systems is organized, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located there, unless local consumer-protection law provides otherwise.

Changes

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
